Constitution
Article
1
Name, Purpose, and Membership
Section I
- Name
The name of
this organization shall be the Bainbridge-Guilford
Teachers Association, hereafter referred to as the BGTA.
Section II
- Purpose
The purpose
of this organization shall be to:
A.
advance th standards of its members' professions.
B. secure
the conditions necessary to provide the greatest
rewards for its members in their work environments.
C.
promote the welfare and well-being of its members.
D.
promote mutual assistance and cooperation with other
organizations with which it is associated.
E. expose
and fight all forms of discrimination.
F.
promote the unity and strength of its members.
Section
III - Affiliations
This
organization shall be affiliated with the New York State
United Teachers and its national affiliates.
Section IV
- Membership
Any teacher
employed by the Bainbridge-Guilford Central School
system, or person designated as such by this association,
may become an active member of this association and
remain in good standing provided dues and assessments are
paid.
Article
II
Executive Body
Section I
- Officers
A. The
officers of the BGTA shall be:
1.
President
2. Vice President
3. Secretary
4. Treasurer
B. The
President shall:
1. be
chief executive officer of the BGTA.
2. administer all affairs and execute all
policies of the BGTA.
3. preside at all meetings of the Executive
Committee and general membership.
4. be and ex officio member of all committees.
5. appoint special committees where expedient.
6. appoint members to fill vacancies on
Negotiations or Grievance committee until an
election can take place.
7. represent the BGTA with all external groups.
8. call regular and special meetings of the
Executive Committee and general membership.
9. fulfill such other duties as the office
requires and as are consistent with this
constitution.
10. maintain permanent files of the BGTA.
C. The
Vice President shall:
1.
assume the duties and responsibilities of the
President in his absence.
2. assume the office of President if the office
becomes vacant.
3. perform such other duties as the President may
designate.
D. The
Secretary shall:
1.
keep a record of all meetings of the association
and of any committee meetings so designated by
the President.
2. be responsible for all correspondence of the
BGTA.
3. transmit copies of minutes to the membership
at-large or committee members as applicable
within five days after the meeting.
4. maintain member confidentaility in minutes and
correspondence at all times.
5. place corrected and approved minutes,
correspondence, and any other matters of record
in the permanent files of the BGTA.
E. The
Treasurer shall:
1. be
responsible for all income and disbursements of
the BGTA.
2. keep adequate records and submit an oral
and/or written report to the membership at each
meeting.
3. submit to the President, in June, a summary of
the year's financial activities.
4. along with the President, prepare a budget for
the following year.
Section II
- Nominations and Elections
A.
Elections shall be held at the general membership
meeting in June.
B.
Written notice announcing the time and place of
elections shall be mailed to each member at least
fifteen (15) days prior to the election.
C.
Election shall be by secret ballot. There shall be no
proxy votes or absentee ballots. Where there is only
1 candidate for an office, election may be by voice
vote at general membership meeting in June.
D. The
results of the election shall be published in the
BGTA News and/or posted prominently in each building.
E. The
Secretary shall preserve all election records,
including ballots, for a period of one (1) year.
Section
III - Terms of Office
Duly elected
officers shall serve a two-year term commencing July 1st
of the year they are elected. Each officer shall remain
in office until their successor assumes the office.
Officer elections shall occur on even years.
Article
III
Committees
Section I-
Executive Committee
A. The
Executive Committee shall consist of the officers
ofthe BGTA, chairpersonsof all committees, and
Building Representative(s).
B. The
Building Representative(s) shall carry out all BGTA
communications within the building. They are to be
elected by the BGTA members within each building. The
number of representatives shall be on the following
schedule.
0 -
12 members = 1 representative
13-20 members = 2 representatives
21-28 members = 3 representatives
29-36 members = 4 representatives
37-44 members = 5 representatives
45-52 members = 6 representatives
C. The
Executive Committee shall:
1.
meet at least monthly.
2. make recommendations for the annual budget.
3. act upon expenditures as may be required.
4. act on policy matters for the BGTA between the
meetings of the general membership.
5. make policy recommendations to the membership
for their consideration.
6. elect any new officer if the office becomes
vacant to serve until the next general membership
election is held.
D.
Special Executive Committee meetings may be called by
the President or by a written petition of a majority
of the Executive Committee.
E. A copy
of the agenda shall be made available to the
membership at-large and all committee members in
advance of the meeting.
F. Any
BGTA member may attend an Executive Committee meeting
to address an issue.
Section II
- Standing Committees
A. The
Negotiations and Grievance Committees shall be
appointed by the President and subject to approval by
the Executive Committee. Respective chairpersons
shall be selected by committee members.
B. The
Negotiatios Committee shall:
1.
Develop, on the basis of member felt needs,
bargaining proposals to be presented to the
Bainbridge-Guilford Central School Board of
Education.
2.
Understand that tentative aggreements entered
into by the committee shall be subject to
ratification at a duly announced Ratification
Meeting.
C. The
Grievance Committee shall:
1. be
competent to judge which issues are true
grievances.
2.
always present grievances with the shortest delay
possible.
D. The
Nominations Committee:
1. A
Nominations Committee shall be appointed by the
President at the April Executive Committee
meeting. It shall be the duty of this committee
to prepare a representative slate of candidates
to be presented for member consideration at the
general membership meeting in June. Nominations
and seconds may also be made from the floor at
that meeting.
Article
IV
Parliamentary Authority
Meetings of
all duly constituted bodies of the BGTA shall be governed
by Robert's Rules of Order except as otherwise provided
in this document.
The Order
of Business shall be:
Meeting
called to order.
Reading of Minutes of the last meeting.
Treasurer's Report.
Committee Reports.
Unfinished Business.
New Business.
Adjournment.
Article
V
General Membership Meetings
Meetings of
the general membership may be caled by the President, by
a majority of the Executive Committee or by written
petition of ten (10) percent of the membership. General
membership meetings shall be held in September and June.
Those members
present at any duly announced meeting shall constitute a
quorum for the transaction of business at any meeting of
the BGTA.
Article
VI
Protection of Rights of Members
Every member
of this organization shall have equal rights and
priveleges to nominate candidates, to hold office, to
vote in elections or referendums, to attend membership
meetings, to participate in deliberations and to vote
upon the business of the organization.
This
organization shall show no discrimination toward any
individual or group of individuals on the basis of sex,
creed, color, race, national origin, or political
activities and beliefs.
Article
VII
Dues and Assessments
Section I - Dues
Membership dues shall
consist of local dues, as approved by membership, plus
affiliation dues. Dues are to be paid by payroll
deduction or payment in full by October 1st.
Article
VIII
Amendments
A. An amendment to
this constitution may be proposed by:
1. a majority
of the Executive Committee.
2. no fewer than ten (10) percent of the
membership.
B. A proposed
amendment must be posted in a conspicuous place
in each building and distributed in writing to
each member at least seven (7) days before the
ratification vote.
C. An amendment
must be ratified by a 2/3 vote of the membership.
D. This
Constitution shall be in force from the date of
its adoption and any alterations or amendments to
the Constitution fo this Organization shall be in
force from the date of that adoption.
