Acceptable Use Policy
PPP(Dial-Up), E-Mail Accounts, Wireless Accounts and Business Accounts - January 21, 2002
1. CPU Industries, Inc. d/b/a MKL.Net will provide Internet services (the service) to the customer (named on the User Subscription Form, Invoice, or Contract) for his/her private or business use. The customer (residential or commercial) must abide by the MKL.Net Acceptable Use Policy which can be found at http://www.mkl.com/acceptle.html or is available via mail at the customer’s request. Any violation of this policy may result in the suspension or termination of the account without notice, investigation by the FBI, NSA, state or local authorities. Violators do not qualify for refunds. Use of an MKL.Net account constitutes an understanding and acceptance of the terms and conditions set forth in this policy.
2. MKL.Net reserves the right to modify the Acceptable Use Policy at any time. Any modifications to this policy will be dated appropriately. MKL.Net also reserves the right to limit or discontinue any Internet service which may compromise network integrity at any time for any reason.
3. An MKL.Net account is personal and private and therefore does not extend to any other person, corporation or entity.
4. An MKL.Net account is non-transferable. Login names and passwords are not to be shared with outside parties.
5. No more than one dial-up connection can be used at any time for each PPP login account. If at any time, more than one instance of an account is found, the account will be suspended immediately without notice for security reasons.
6. A residential or commercial account does not constitute a dedicated connection. An inactivity time-out of twenty minutes has been engineered in the PPP daemon to ensure fair access to all customers. Any attempt to bypass such measures is a breach of this policy; examples of such measures are: ping daemons, IRC and mail bots.
7. Subscriptions are available only to endusers. Unauthorized sharing and/or reselling of bandwidth is not permitted.
8. Any attempt to violate the security, stability, integrity of any MKL.Net server is strictly prohibited.
9. The use of any NNTP emulator is prohibited while using a PPP account.
10. Storage and/or distribution of pornographic materials or illegal materials (material which MKL.Net deems threatening or obscene) on MKL.Net’s services is prohibited. This includes virus code and tools used for hacking computers and networks. There is also no room on MKL.Net's network for storage of offensive material with racial and/or white supremacist overtones.
11. Tampering with the return address or route report on any E-mail message or Usenet news message is prohibited. Anonymous transmissions of any sort are prohibited.
12. MKL.Net customers must abide by the terms and policies of any service to which he/she connects. Obtaining these policies is the direct responsibility of the customer.
13. MKL.Net customers must abide by the net-wide accepted rules of Internet conduct. An example of netiquette can be found at http://jade.wabash.edu/wabnet/info/netiquet.htm.
14. Each PPP account is provided with one E-Mail account. Additional E-Mail accounts may be purchased at a rate of $3.00 per month.
15. Each PPP is provided with two megabytes of storage space on MKL.Net servers for FTP, E-Mail and WWW files. Storage space exceeding 2MB will result in automatic removal of the largest file after 7 calendar days. You may ftp large files over to your home directory and store than for 7 days, after which they will automatically be deleted by a timer. There is an extra disk space fee charged for all Personal Accounts that exceed 2MB. This space is for Personal use ONLY. Any attempt to use the space for business or commercial use will be billed at least the price of a commercial hosting fee at the time of the use. Other fees may apply.
16. The customer is responsible for a basic working knowledge of his/her operating system/interface (Windows, MacIntosh or UNIX). Technical support representatives are not responsible for general computer support. Any technical assistance given to the customer, outside the bounds of Internet service, is at the discretion of the representative, and could result in a charge. No customer equipment is accepted for repair without a Maintenance Contract and an appointment approved by the System Network Administrators. All violators will be charged for any and all technical support they receive.
17. MKL.Net offers free technical support via telephone for initial connection and E-Mail issues only. Any additional technical support requests should be sent to support@mkl.com. Technical support is available Monday through Friday from 9:00 AM EST to 8:00 PM EST and on Saturdays from 10 AM to 3 PM EST. The technical support request number is (607) 967-3800. In addition,you may leave a message with the answering service 24 hours a day.
18. Mkl.Net reserves the right to deny anyone service for any reason and to change these terms of use at any time, for any reason.
19. All account changes must be made in person by the account holder ONLY. Any other persons who attempt to make changes or falsely present themselves as the account holder may be charged with a criminal offense. MKL..Net reserves the right to give any or all personal or account subscriber information to any or all Federal, State, Local or International Agencies of Criminal Investigation.
20. Although commercial entities may utilize a dial-up account, the 2 megabytes of space provided for ftp and world wide web files is for personal use only. Advertising at this space is at the discretion of MKL.Net personnel. Any mass mailing or mass posting to Usenet Newsgroups, other Newsgroups, websites or e-mail addresses is prohibited. SPAM (unsolicited e-mail) is not allowed on our servers. All MKL.Net PPP accounts are prohibited from creating, sending or in any way attempting to SPAM our subscribers or anyone else on the World Wide Web. If you are receiving SPAM please report it to webmaster@mkl.com immediately.
21. The customer agrees to pay all bills, initial and recurring, by the billing date listed on the initial invoice and payment coupons. All setup fees and first month’s fees are non-refundable unless the customer is unsuccessful in using the account, and must be approved by the Executive Board which includes members of the Accounting Department, CEO and Network Admin Staff. All refunds will be issued within 1 full year after service was terminated. Bills will not be prorated. Any cancellation must be made in writing (e-mail, FAX, or US Post Office) and will become effective at the end of the last billing cycle. Any account which goes unpaid for more than 15 days will be suspended without notice. A $10 reconnection fee may apply to resume service. Any account that remains unpaid for more than 30 days will automatically be placed into collection with the intent to recover the cost of rendering service, interest and collection fees. Returned checks are subject to a charge of $20.00. Cancellations must be made in writing. No refunds for unused portions of the service contract are issued unless the account holder has moved outside of the MKL.Net Dial Up Area. Proof of new residence will be required.
22. Customer hereby indemnifies, protects and holds harmless and hereby releases CPU Industries, Inc., d/b/a MKL.Net and Internet Communications LLC and all of its officers , agents and employees from and against any and all liability, losses, injuries, damages, claims, demands, suits and fees, cost or judgments which may arise out of any negligent act or omission of CPU Industries, Inc. d/b/a MKL.Net, Internet Communications LLC, and its successors, executors or administrators.
23. Any experimentation, comparison or usage of the MKL.Net network for the purpose of benchmarking is prohibited without the express written consent by CPU Industries, Inc.
